Desafíos jurídicos del derecho al honor y la libertad de expresión en las redes sociales. Autorregulación y responsabilidad

Esta investigación realiza un análisis de la confrontación entre las libertades informativas y la protección del honor en las redes sociales (RRSS). El objetivo es ponderar estos derechos y determinar las colisiones típicas entre ambos derechos, los riesgos específicos que presentan las RRSS para el honor de los usuarios, y la responsabilidad de los actores que intervienen en el proceso comunicativo. Igualmente, repasa la regulación jurídica existente en España sobre esta materia, así como los intentos de autorregulación y los que propiamente establecen las mismas RRSS en sus condiciones de uso, para por último establecer los retos y desafíos de las redes sociales en relación con la protección del honor y las libertades informativas.

This research carries out an analysis of the confrontation between the freedom of information and the protection of honour in social networks. The aim is to weigh up these rights and determine the typical collisions between both rights, the specific risks that social networks present for the honour of users, and the responsibility of the actors involved in the communicative process. It also reviews the existing legal regulation in Spain on this matter, as well as the attempts at self-regulation and those established by the social networks themselves in their conditions of use, in order to finally establish the challenges of social networks in relation to the protection of honour and freedom of information.
